I’m a single parent. My daughter’s father & I both have medical coverage 4 her….?

…How do I get around the b-day rule.
We were never married and do not have a divorce decree. I want his insurance to be listed as primary and mine as secondary. I feel that it should be this way because aside from child support I don’t see any extra money like for school registration, school supplies, sports fees etc. The insurance companies say that because my birthday occurs first in the year I have to be primary. Does anyone know if there is a form or something I can fill out.

To change it from the outside you would have to have a court order- for instance, if a court order mandates that the father carries insurance for the child then his insurance becomes primary. If you don’t have that, it might even be possible to get a court to order it – I don’t know. Barring that I would call the insurance companies and ask them to make an exception. Go as high up in the company as you can. Since I don’t know what insurances you are dealing with, I can’t offer any expectation of success, but it is certainly worth a try. I know exactly why you might want the other insurance to be first and why you might feel you need to keep both insurances. We see problems in that area all the time. It really should be that the parents should be allowed to choose which insurance is first. Sometimes insurance companies do it by alphabet, and others by birth year- all arbitrary, and all certainly affect the clients without giving them any choices. It is something worth fighting, if you can! Good luck!
